No, 这是移民局的说法，针对其B-2身份。
但是，就公立学校而言，考虑的并不是这个身份，该孩童，或孩童之父母、监护人的身份，不是该孩童能否入学所要考虑的因素。因素是该生是否居住在该校所覆盖的学区。
2011年5月6日司法部和教育部联合下文，重申了这一点。
"Both the United States Department of Justice and the United States Department of Education (Departments) write to remind you of the Federal obligation to provide equal educational opportunities to all children residing within your district and to offer our assistance in ensuring that you comply with the law."
入学不成问题了"
现在 worry 的 I-94 的停留期。通常的 B-2 只有六个月，离完成学业，差的还挺远。,,,而过期停留，又担心以后受十年之禁。
其实,,,所谓的三、十年之禁，对于十八岁以下的未成年人是网开一面的。
"No period of time in which an alien is under 18 years of age shall be taken into account in determining the period of unlawful presence in the United States"

所以，在美国当小留学生还是可行的,,,十八岁一到，要么得向移民局申请，要么去领事馆签证。虽然有不足十八岁可以免除三、十年之禁，但移民局或领事馆是还是可以拒你的申请的，就象普通的申请有被拒的可能一样。.
